General terms of sale
Preamble:
The online shop of the website 'EBLASTSHOP.fr' was set up by the company 'EBlastshop SARL', a limited liability company (SARL) with a capital of €10,000, located at 7 rue de la Planche Pierrette in DROUE SUR DROUETTE (28230), France. This company is the operator of the site (hereafter referred to as "EBLASTSHOP")

Any order of products from the online shop of the website available at the URL (hereafter referred to as "the Site") requires consultation and prior acceptance of these general terms of sale (hereafter referred to as GTS).
The GTS are applicable to all physical persons acting in a private capacity (hereafter known as "the Consumer" or "You") wishing to make a purchase via the Site.
Article 1: Purpose
The purpose of the GTS is to define the rights and obligations of the parties in connection with the online sale of goods to the Consumer offered by the company EBLASTSHOP, from the moment the order is placed to delivery.
Article 2: The products
EBLASTSHOP makes every effort to provide full information to the Consumer about the products, in particular concerning prices and product characteristics.
Photographs of the products are provided for illustration purposes and are not contractually binding.
The products offered by the company EBLASTSHOP are valid only within the limits of available stock. In the event of unavailability of the product ordered, in particular in the case of a supplier shortage, the Consumer will be informed as soon as possible and will be able to cancel the order. The Consumer will then have the option of requesting either a refund of any amounts paid, at the latest within 30 days of their payment, or the exchange of the product.
The unavailability, even prolonged or indeterminate, of one or several products, may not constitute injury to the Consumer and cannot under any circumstances result in compensation being paid by EBLASTSHOP.
Article 3: Ordering
3.1 Identification
To place an order, the Consumer must identify himself or herself by entering his or her email address and password.
If the Consumer has lost or forgotten the password, a new password may be obtained by clicking on "My account" and then clicking on the link entitled "Forgotten your password? Click here". The consumer will then receive a new password via email, at the email address provided at the time of registration.
When placing his or her first order, the Consumer must first register with the Site by entering his or her surname, first name, date of birth, email address, postal address, telephone number (landline and/or mobile) and must indicate whether or not he or she wishes to receive the EBLASTHOP newsletter. A password must also be entered in order for the consumer to be able to directly access his or her customer account the next time they connect.
The Consumer undertakes to provide accurate information. Failure to do so may result in termination of the contract by EBLASTSHOP and deletion of the customer account.
The information provided is required for order confirmation and shipping.
3.2 Order validation
Once the item has been selected, the Consumer must validate the shopping basket after having checked the number of articles, prices, colours and sizes, and accepting these GTS.
The Consumer must then choose one of the delivery options and, if desired, request that the items be gift wrapped.
The Consumer must then check the delivery address, enter any promotional code they may have and choose the payment method (credit card, Paypal or cheque).
The order validation process is completed once this last step has been carried out and the consumer has clicked on the link "CONFIRM ORDER".
3.3 Order Confirmation
Once the Consumer's order has been completed, EBLASTSHOP will acknowledge receipt of the latter by sending a confirmation email within 24 hours of the order being placed.
All of the contractual information will be confirmed via e-mail no later than at the time of delivery or will be sent to the address specified by the consumer on the order form.
In the event that the Consumer is unable to access the site, due to technical problems or for any other reason, he or she is not entitled to any compensation.
Article 4: Prices
Prices are indicated in euros, inclusive of all taxes, and are only valid on the date of validation of the order by the Consumer. They do not include shipping costs, which are billed separately and specified before validation of the order. Prices include the VAT applicable on the day of ordering, and any change in the applicable VAT rate will be automatically integrated into the price of the products in the online shop.
Payment must be made in full at the time of ordering. Payments made will at no time be considered as advance payments or deposits.
Prices may not be changed after confirmation of the order.
Article 5: Payment method
The Consumer may choose from any of the payment methods indicated on the order form to pay for his or her order:
- By bank card (Secure payment. Data processed in SSL encrypted mode; see article 9: "Security")
- Via Paypal
- By bank transfer
Upon validation of the order form, the Consumer guarantees EBLASTSHOP that he or she has any authorisation required to use the chosen method of payment. EBLASTSHOP reserves the right to suspend the processing or shipping of an order in the event that a payment by bank card is refused by an officially accredited organisation, or in the case of non-payment. In particular, EBLASTSHOP reserves the right to refuse delivery or fulfil an order from a Consumer who has not fully paid or partly paid a previous order, or with whom a payment dispute is ongoing. EBLASTSHOP has established an order control procedure to ensure that nobody may use the bank details of another person without his or her knowledge. In order to carry out this control, the customer will be asked to send proof of identity and proof of address to EBLASTSHOP via email. The order will only be validated once our services have received and checked the documents sent.
Article 6: Terms of delivery
6.1 Delivery times
The delivery times defined below will not begin until the date that payment is actually received by EBLASTSHOP.

The products ordered will be shipped on the same day and delivered as quick as possible for any order placed before 1 pm on Fridays and the day before a public holiday. For any orders placed after this time, the delivery time is extended by another 24 hours.
In the event of late delivery, the Consumer is requested to report this delay to EBLASTSHOP by calling us (on 0811 46 10 66 from Monday to Friday) or by sending us an email ([email protected]).
In any case, in the event that the delay in delivery exceeds 7 days from the specified delivery date, you are entitled to cancel your order by sending us a registered letter with acknowledgement of receipt, in accordance with legal provisions. In this case, if the product is received after cancellation, EBLASTSHOP will refund the product and return shipping costs upon receipt of the item in its entirety and in its original state.
This clause does not apply if the delay in delivery is due to a case of force majeure that is beyond the control of the website editor. In such cases, the customer agrees not to initiate legal proceedings against the site and its editor and waives the right to cancel the sale referred to in this article.
6.2 Delivery address
Products can be delivered to the address specified by the Consumer upon validation of the order in the following countries: France (including the Overseas Departments and Territories), Germany, Austria, Belgium, Canada, Denmark, Ireland, Spain, the USA, Finland, Greece, Italy, Luxembourg, Norway, New Caledonia, the Netherlands, Poland, Portugal, the United Kingdom, Saint Pierre and Miquelon, Sweden, Switzerland, Wallis and Futuna.
6.3 Arrangements
EBLASTSHOP delivers its products exclusively via IMX and Colissimo delivery services. We will inform you via email as soon as your order is dispatched.
6.4 Reservations
The Consumer must notify both the carrier and EBLASTSHOP of any reservations they may have concerning the package delivered. This must be done by letter or email and within 3 working days of receipt of the item(s).
In the event that the package is seriously damaged (torn packaging, package opened, products damaged, etc.), the Consumer should refuse the package and specify the reasons for refusal on the delivery document.
A new package will then be prepared and shipped upon receipt of the returned damaged package. In such cases, the delivery times mentioned earlier in the GTS will no longer apply.
Article 7: Guarantees
EBLASTSHOP undertakes to comply with its obligations relating to the legal requirements provided for by the French Civil Code (Article 1641 et seq. of the French Civil Code) and the French Consumer Code (Article L211-4 et seq.) governing the products marketed on the Site.
Article 8: Right of withdrawal
If the consumer is not entirely satisfied with the product, he or she has 30 clear days from receipt of the products ordered to return any unwanted items at his or her own expense. EBLASTSHOP must be notified of any returns: - preferably via email at: [email protected], - by logging on to our site and clicking on "track your order", or after entering your customer number, you can access your order number.
In order to exercise your right of withdrawal, you can return the product at your expense via Colissimo Recommandé, in its original packaging and along with the order number to:

In accordance with the provisions of articles L121-20 et seq. of the French Consumer Code, the Consumer may not exercise any right of withdrawal for the following products:
Therefore, products such as records, CDs and DVDs can only be returned if the cellophane has not been removed, so that the consumer may exercise his or her right or withdrawal.
Products that have been damaged will be neither refunded nor exchanged.
This right of withdrawal can be exercised without any penalty, except for the return shipping costs. If the event that the right of withdrawal is exercised, the Consumer has the option of requesting either a refund of amounts paid or the exchange of the product. If the right of withdrawal is exercised, EBLASTSHOP will make every effort to refund the consumer as quickly as possible, and will do so, at the latest, within 30 days of the right being exercised. The consumer's bank account will be re-credited (secure transaction), if payment was made by bank card, or by cheque in all other cases.
Article 9: Security
Our partner CREDIT AGRICOLE offers you a simple and secure remote payment solution via secure e-commerce transactions, for your complete peace of mind: In order to ensure optimum security, this service includes: - SSL (Secure Socket Layer) encryption of the data entered upon payment - direct and entirely secure transmission of bank details. The data entered is encrypted and then processed by Crédit Agricole, which is the only party able to decrypt it. - payment using French or international bank cards from anywhere in the world (cards issued in France or abroad and affiliated to the VISA or Eurocard/Mastercard network).
Article 10: Loyalty points
Every time you place an order via your eblastshop.fr account, you will earn points that will entitle you to discounts off subsequent orders. Full details may be found in the "loyalty points" section.
Article 11: Chat
EBLASTSHOP provides a free chat service (excluding internet connection costs), allowing you to contact our customer service team with any questions you may have.
Article 12: Data protection
The data requested of the consumer is necessary for processing the order and may be disclosed to EBLASTSHOP's contractual partners involved in the order process. The consumer may write to EBLASTSHOP to oppose the communication of such information or to exercise his or her right to access, modify or delete data contained in EBLASTSHOP's files concerning himself or herself, according to the conditions provided for by the law of 6 January 1978 (refer to the legal notice for more information).
Article 13: Miscellaneous
Should one or more clauses of these general terms of sale be deemed invalid or declared as such pursuant to the law or regulations, or as the result of a definitive ruling by a competent court, the other clauses will retain their full force and scope.
The fact that one of the parties does not take advantage of a failure by the other party to comply with any one of the obligations mentioned in these general terms of sale may not be construed as a waiver of the obligation in question.
The present GTS are subject to French law in both substance and in form. In the event of a dispute or claim, the Consumer should first contact the company EBLASTSHOP so that an amicable solution may be sought.
